SUMMARY:Social Work Meetup: Team Work Makes Dream Work
DESCRIPTION:Team work in defense based teams is critical to comprehensive and quality representation of clients. But what happens when you feel like you are working in a silo as a mitigation specialist? This discussion will focus on ways we can proactively\, actively\, and responsively work our ways into the team (or reintegrate back into the team) to do our best collective and collaborative work. Join the discussions to share ways you put yourself back in the team! \nStephanne Cline Thornton is a West Virginia native who has worked in and around criminal defense and mitigation for more than 20 years in Georgia\, Colorado\, and West Virginia. She is currently the Social Work Training and Resource Coordinator for NAPD\, Clinical Director for the West Virginia Judicial and Lawyer Assistance Program\, and owner of Transform Legal\, a consultancy focused on mitigation\, training\, and sustainability. As a Licensed Independent Clinical Social Worker and Master Addiction Counselor\, Stephanne focuses on proper assessment for and access to trauma and substance use disorder treatment to ensure the health and well-being of affected individuals. Stephanne is on the Trauma-Informed Care Network Speakers Bureau and uses that platform to call attention to the intersection of secondary traumatic stress and legal practice. She approaches her work with clients\, lawyers\, social workers\, and mitigation specialists through a contextualized mitigation lens. \n

SUMMARY:Sleep Disturbances and Disorders: Criminal Justice\, Forensic Mental Health\, and Legal Considerations
DESCRIPTION:Adequate sleep is the foundation to optimal emotional\, behavioral\, social\, and physical health functioning. Unfortunately\, problems associated with sleep are a common issue among individuals in the general population\, with even higher rates reported among criminal justice and forensic mental health-involved populations. As such\, it is imperative for these impacted individuals to receive appropriate supports and services from professional providers who understand the complexities of sleep dysfunction and its implications for concerning\, problematic\, criminal\, and vulnerable behaviors. Designed for professionals working in criminal justice\, forensic mental health\, and legal settings\, this training provides attendees with a working understanding of the causes\, consequences\, and interventions associated with sleep disturbances and disorders among criminal justice and forensic mental health-based populations. Other topics discussed in this training include anger\, aggression\, and violence\, incarceration\, suggestibility\, misinformation effect\, fantasy proneness\, false confessions\, vulnerability and victimization\, executive dysfunction\, error monitoring deficits\, uncertainty\, rule following problems\, carelessness\, problematic coping strategies\, circadian rhythm misalignment. language impairment\, auditory processing deficits\, social cognition\, sluggish cognitive tempo\, comprehension deficits\, fatigue\, information processing deficits\, choice-making deficits\, abstract reasoning deficits\, memory confusion\, self-regulation deficits\, and sensory processing limitations to name a few. Empirically based research findings examples will be highlighted throughout this training. \nJerrod Brown\, Ph.D.\, M.A.\, M.S.\, M.S.\, M.S.\, is a professor\, trainer\, researcher\, and consultant with multiple years of experience teaching collegiate courses. SUMMARY:Virtual Open Space on Public Defense Independence
DESCRIPTION:  \n\nProtecting Independence \nTo serve their clients\, public defenders must be free from political and judicial control. NAPD’s Foundational Principles and the American Bar Association’s (ABA) Ten Principles of a Public Defense Delivery System therefore discourage practices that undermine defense independence\, like: \n\nJustices controlling oversight boards\nLaw enforcement officials having oversight roles\nGovernors having exclusive appointment powers\nCounty officials removing directors at will\nJudges selecting defense lawyers for their courtrooms\nJudges restricting defense expenses\n\nWhen independence is challenged\, NAPD makes our voice heard\, most recently in places like Connecticut\, Louisiana\, and Colorado. We are now partnering with the ABA Criminal Justice Section and Standing Committee on Legal Aid and Indigent Defense on a Task Force on Public Defense Independence. NAPD and the ABA Task Force are co-hosting this event. \nThis virtual Open Space event is an opportunity for defenders from around the country to workshop local issues and shape national advocacy on this key issue. \nOpen Space Format \nRather than having experts deliver presentations and answer questions\, Open Spaces are designed for participants to start their own “rooms” for discussions and move between those rooms freely\, guided by where they feel they are learning and contributing. \nWe will have a brief opening in which participants offer their own topics for discussion\, then have two rounds of discussion in which they can move from room to room. We will close by sharing notes from each discussion\, which will be sent to all meeting participants. \nPast virtual Open Spaces on recruitment and workloads have produced practical strategies for addressing those challenges. Please join us on September 19 to discuss how to take action to protect the integrity of public defense systems.

SUMMARY:Social Work Meetup: Writing Without Placing Blame
DESCRIPTION:In mitigation writing\, there is a delicate balance of identifying the harms done to the client while not (always) overtly placing blame on the parent or adult provider. The client may benefit from the parent/provider as a lifeline for their future\, or may not see the situation in the same way as you; thus\, discretion in writing (and blaming) is important. How do you address intergenerational trauma\, or other harms committed by the parent or adult provider\, while still working to preserve the role of the parent/provider in the client’s life for the future? \nStephanne Cline Thornton is a West Virginia native who has worked in and around criminal defense and mitigation for more than 20 years in Georgia\, Colorado\, and West Virginia. SUMMARY:Team Mitigation Institute - Seattle
DESCRIPTION:Mitigation created by a team of professionals in non-capital cases is increasingly becoming the standard of practice. This bring-your-own-case institute is designed for defense teams to work on the mitigation for a non-capital client.  The institute is a mix of presentations followed up by small group work facilitated by experienced faculty.   Participants are encouraged to come with their defense team (attorneys\, investigators\, paralegals\, social workers\, mitigation specialists and other sentencing advocates).  However\, if all of your team members are unable to attend\, sole participants are also welcome. \nSmall groups will be assigned to promote discussion among teams handling similar types of cases (i.e.\, offense charged\, juvenile or mental illness).  In addition\, some teams will work on cases where clients have a realistic chance of diversion while others may work toward reducing the term of incarceration for clients. \nPricing before July 15\, 2024   $450 NAPD Members\, $600 Non Members \nPricing July 16 and beyond  $550 NAPD Members\, $700 Non Members \nAugust 16th registration deadline \nWe know you may need to convince someone else to approve you joining us.   Check out our Convince Your Boss Resources for a sample letter and other information. \nApply for registration fee scholarship here   Scholarship deadline August 1. \nWe have a hotel room block with the Silver Cloud Hotel Broadway for $229 per night plus taxes and fees. SUMMARY:Fetal Alcohol Spectrum Disorder (FASD): Criminal Justice\, Forensic Mental Health\, and Legal Considerations
DESCRIPTION:Fetal alcohol spectrum disorder (FASD) is a lifelong neurodevelopment disorder caused by prenatal exposure to alcohol. This spectrum of disorders is characterized by deficits in cognitive (e.g.\, inhibition\, information processing\, and memory) and adaptive functioning (e.g.\, communication skills\, problem-solving\, and decision-making). These symptoms place some individuals with FASD at risk for involvement in the criminal justice system. Once involved\, individuals with FASD usually struggle to make legal decisions\, participates in their legal defense\, and conform to conditions of incarceration or community supervision. Designed for professionals working in criminal justice\, forensic mental health\, and legal settings\, this training broadens awareness of FASD and identifies practices and techniques designed to improve outcomes when working with persons with suspected or confirmed FASD. Other topics discussed in this training include executive dysfunction\, suggestibility\, confabulation\, gullibility\, auditory processing deficits\, alexithymia\, theory of mind (ToM)\, sluggish cognitive tempo\, comprehension deficits\, sleep disturbances and fatigue\, information processing deficits\, choice-making deficits\, abstract reasoning deficits\, memory confusion\, self-regulation deficits\, and sensory processing limitations to name a few. Empirically based research findings and case study examples will be highlighted throughout this training. \nJerrod Brown\, Ph.D.\, M.A.\, M.S.\, M.S.\, M.S.\, is a professor\, trainer\, researcher\, and consultant with multiple years of experience teaching collegiate courses. SUMMARY:Investigator Meetup: Combatting AI – Identifying and Challenging AI Applications in Law Enforcement W/ Giselle Pomereau esq.
DESCRIPTION:Combatting AI – Identifying and Challenging AI Applications in Law Enforcement \nGiselle Pomerleau\, Litigation Technology Attorney\, Office of the Federal Defender for the District of New Jersey\, Camden\, NJ \nArtificial intelligence (AI) is everywhere these days and law enforcement is no exception. This session highlights what to look for and addresses three emerging issues related to AI: (1) credibility (e.g.\, what if law enforcement use AI to profile a driver and then create a pretext for a traffic stop); (2) reliability (e.g.\, when AI is used as evidence or starting point of investigation\, how do we use Daubert?—think ShotSpotter); and\, (3) admissibility and authentication (e.g.\, how to deal with possibility of deep fakes). \nGiselle Pomerleau\, Esq. is the Supervisor of Training and Litigation Support for the Office of the Federal Public Defender\, District of New Jersey\, where she has been since 2010. She is a frequent presenter on the impact of technology trends in criminal defense practice.  Giselle has also taught e-discovery management strategies and implemented e-discovery management training programs within her office. She focuses a large part of her practice on complex\, high-volume cases with technical elements. Giselle has also previously taught in the Criminal Justice department at La Salle University in Philadelphia\, Pennsylvania. \nFor the month of August\, we will not be having any meetups\, so next week we will be having 2 meetups!    Next Wednesday 7/24 for international investigator day\, Giselle Pomerleau will be talking about Body worn Cameras and what things to pay attention to about them.  Then on Friday 7/26 Prabhas Pokharel from Reduct will be talking about some very cool tools involving body cams as well! I hope you can join us for both sessions.

SUMMARY:Social Worker Supervisor Discussion
DESCRIPTION:Last month we continued talking about training and then moved into caseload standards and the topic became a jumping off point to talk about social work roles in the office\, how to manage time and bandwidth when caseloads are crushing\, how to educate attorneys on all of the activities that we and our supervisees do. We didn’t get to clinical supervision so we’d like to get started this time talking about clinical supervision and see where that leads us. We’ve heard that there are a lot of you who are alone in the office or alone as supervisors. Come join the conversation and get access to important articles\, forms and resources. \nFacilitated by: Kevin Bishop\, LCSW\, Social Worker Coordinator with The Office of the Alternate Defense Counsel (CO); Michael E. Moore\, LMSW\, Social Work Supervisor with The Legal Aid Society\, Criminal Defense Practice (NY); and Claudia Dunne\, LICSW\, Director of Social Work & Private Social Service Vendors\, Youth Advocacy Division (YAD)\, CPCS (MA). \n

SUMMARY:Social Work Meetup: Addressing Scarcity as a Mitigation Theme
DESCRIPTION:This week’s meetup will focus on scarcity (poverty) as a mitigation theme. This topic can include so many approaches from how scarcity relates to social determinants of health\, to lack of access and opportunity\, to intergenerational lack of assets (and why)\, and more. Come share how you approach the topic of scarcity as a mitigation theme and make it meaningful and compelling to the finders of fact. \n
